Terms of use of the service and purchase of damage history Reports.

I. Introduction

These Terms and Conditions define the rules for using the website operated under the name ‘report.vin’ in the ‘report.vin’ domain (hereinafter: the ‘Website’). Non-acceptance of the Terms and Conditions makes it impossible to use the Website.

The purpose of the Website is the paid provision of damage and event history reports (hereinafter: the ‘Report’) for a specified vehicle, based on the provided VIN and/or registration number, in accordance with sections II–III.

We make every effort to ensure the Report is reliable; however, due to the nature and origin of the data, we cannot fully verify its conformity with the current factual state. The Report is an auxiliary tool – before making decisions regarding the vehicle, its current condition and documents must be verified (inspection, test drive, diagnostic examination).

If discrepancies between the Report and the actual condition are noticed, please inform us – in justified cases, we may temporarily suspend the presentation of disputed data and initiate clarification actions with their provider.

The scope of data in the Report depends on the availability of information in the Sources (section II) at the time of the query. Before purchasing the Report, the Website may present preliminary information about the expected scope of data.

The Report does not contain personal data – it concerns exclusively vehicle data.

The services are intended for natural persons, legal entities, and other units with headquarters/residence in Europe (including the EEA) and North America. The services are available only to persons who have reached the age of 18 and have full legal capacity.

The principles of personal data and cookie processing are specified in the Privacy Policy available on the Website.

Technical requirements: device with internet access, up-to-date web browser with JavaScript enabled, software for displaying PDFs, active email address. We are not responsible for lack of access resulting from failure to meet technical requirements.

II. Definitions

Consumer –a natural person acting for purposes not directly related to their business or professional activity, as well as a natural person using the data in connection with their business activity if this is not of a professional nature.

Report – a set of data about the history of damages and/or events related to a specific vehicle, including, among others, information on collisions, traffic damages, recorded incidents such as repairs, optionally selected technical data and event metadata (e.g., date, country/region) – as of the moment data is obtained from Sources. This data should only be treated as an auxiliary tool for assessing the history and condition of a given vehicle, as it is not fully verified for compliance with the current factual condition.

Sources – sources of vehicle data available to us, including: our databases, third-party databases (including publicly accessible ones), as well as official and unofficial registers, e.g., in relevant jurisdictions: NMVTIS (vehiclehistory.bja.ojp.gov), other public services of appropriate authorities, and commercial partner databases. These sources do not constitute an official registry, although some data may originate from public registers.

III. Content rights on the Site

Unless otherwise specified, all intellectual property rights to the Site and its content (including trademarks) belong to us or our licensors.

Without our prior written consent, the following are prohibited in particular:

  • distribution of materials obtained from the Website (including distribution on another website)
  • sale, rental, lending, donation, transfer, or sublicensing concerning the Website or materials from the Website
  • public performance of any materials from the Website
  • reproduction, duplication, copying, or other use of materials from the Website for commercial purposes or
  • altering or otherwise modifying any materials on the Website

Use within the scope of permitted use and within the license granted to the user in connection with the purchase of the Report (section VII.6) is allowed.

IV. Website Usage

It is prohibited to use the Website unlawfully, harmfully, or contrary to good manners, including attempts to access data not made available to users, automated data harvesting (scraping, data mining) without our consent, spreading malicious software, sending unsolicited commercial information, and marketing activities without our consent.

The user is obligated to update their account data (if an account is created).

V. Limited Access

Access to some Website resources is restricted. We have the right to limit access to other Website resources or the entire Website, subject to user rights arising from previously concluded agreements.

If the user obtains from us a login or password enabling access to restricted-access resources on the Website or other restricted-access content or services, the user is obliged to secure the password and login so that they are not disclosed to any third party.

VI. User Content

Content uploaded/published by the user must not violate the law, social norms, or third-party rights.

We reserve the right to remove or modify unlawful content.

We are not obliged to constantly monitor content.

The user should keep copies of their own content independently.

VII. Report Order and Payments

Access to the Report is subject to payment. Payment is made exclusively through the systems provided on the Website (e.g., PayU, PayPal, payment cards) – in accordance with the regulations of these operators.

To obtain the Report, the user:

  1. provides VIN and/or vehicle registration number;
  2. receives preliminary information about data availability;
  3. selects the scope of the Report and the payment method;
  4. creates an account or logs in (if required).

The agreement for providing the Report is concluded upon successful payment. The Terms and Conditions form part of the agreement. The Report is made available automatically after payment is booked.

Service prices are stated on the Website and include applicable taxes unless explicitly indicated otherwise.

VAT invoice: available to order via email.

Report availability period: Reports remain available in the user account for at least 30 days from purchase; after this period, they may be removed.

License: with the purchase of the Report, the user receives a non-exclusive, non-transferable license to use the Report solely for their own informational needs, without the right to public distribution/sharing with third parties.

VIII. Statements and Reservations

Based on an agreement with the user for granting access to the Report, we undertake to provide data about a specific vehicle that is currently available to us in the Sources. Therefore, it may occur that some expected data will not be available in the Sources. Consequently, the Report serves only as an aid and guidance for the user. For objective reasons, we cannot guarantee that the data in the Report is complete, up-to-date, and fully consistent with the current actual condition of the vehicle.

If the specification of basic vehicle information contained in the Report is based on decoding data from the VIN assigned to this vehicle by the manufacturer, it will not show changes made to the specific vehicle after its production.

In the case of users who are not Consumers, within the limits provided by applicable law, we do not make any representations (in particular regarding service standards on the Site and its use), exclude warranties, do not provide quality guarantees, and do not guarantee the correctness of decoding the basic identifying data of the vehicle, particularly the VIN number.

IX. Liability

The purpose of the provisions of these Terms and Conditions is not to limit or exclude our or the user's liability in any way contrary to the law; in particular, the Terms do not exclude our or the user's liability for damages caused by intentional fault.

Exclusions and limitations of liability provided in the Terms and Conditions:

  • are subject to the restrictions indicated in paragraph 1 above;
  • concern any liability that may arise under the Regulations ..., including contractual, tortious or other similar liability;
  • do not apply to Consumers.

For users who are not Consumers, to the extent permitted by applicable law, we are not liable for:

  • damages of any kind, especially for lost profits, unless the damage resulted from our intentional fault;
  • loss or damage of any data, database, or software of both ours and the user’s.

We are not liable for any damages arising in connection with events beyond our control, unless otherwise required by mandatory provisions of law.

The report is provided solely to the user who is party to an agreement with us for providing the Report and should not be made public without our prior consent.

For users who are not Consumers, if information contained in the Report originates from the National Motor Vehicle Title Information System (NMVTIS), using the Website means acceptance of the liability limitations indicated by NMVTIS at the website vehiclehistory.bja.ojp.gov, and acceptance of the regulations of those databases.

X. User Obligations (Compliance)

The user declares that they use the Website in compliance with the law applicable at the place of use and has a legitimate interest in obtaining the Report about the specified vehicle; they will not use the Report for unlawful purposes or violating personal rights of third parties.

The user acknowledges that the Report does not replace an inspection of the vehicle or a professional technical examination.

XI. Disclaimer of Liability (Indemnification)

Users who are not Consumers indemnify us against liability and cover damages/costs (including costs of proceedings and settlements) resulting from their violation of the Terms or the law, to the extent permitted by law.

XII. Terms Violations

In case of violations, we may take actions appropriate to the risk scale, including temporary suspension of the account, access blocking (including IP blocking), contract termination, account deletion, and legal action.

XIII. Third-Party Rights

The Terms regulate exclusively the relations between us and the users; they do not grant rights to third parties.

XIV. Assignment

The user may not transfer rights and obligations from the agreement without our consent.

We reserve the right to transfer rights and obligations arising from agreements with users who are not Consumers without their consent.

XV. Complaints and Disputes

Technical complaints, comments on Reports, and other notifications should be directed to the channels specified in section I.2. We respond promptly, no later than within 14 days.

Consumers may use alternative dispute resolution (in Poland: information at UOKiK website: polubowne.uokik.gov.pl ; ODR platform: ec.europa.eu/consumers/odr ). Usage is voluntary for both parties.

XVI. Applicable Law and Jurisdiction

The Terms and Conditions are subject to Polish law; in matters not regulated, the Civil Code, Consumer Rights Act (for Consumers), and the Act on Providing Services by Electronic Means apply, among others.

For users who are not Consumers and Consumers residing in Poland at the date of contract conclusion – disputes are subject to the exclusive jurisdiction of Polish courts.

XVII. Severability Clause

The invalidity of any provision does not affect the validity of the remaining ones; where possible, the provision shall be applied after removing the invalid part.

XVIII. Terms Changes

We may change the Terms and Conditions for important reasons, in particular: changes in law, significant economic changes, force majeure, changes in the scope of services or purchase procedures, changes in payment methods, changes in security measures.

The change takes effect by publishing the new wording on the Website and emailing users of ongoing services (accounts). The new wording applies 14 days after publication and concerns agreements concluded after that date and ongoing services. The user may unsubscribe within 14 days of notification.

XIX. Right of Withdrawal from the Contract (Consumers)

Consumers generally have a 14-day right of withdrawal from a distance contract.

Exception: the right of withdrawal does not apply to digital content not supplied on a tangible medium (Report), for which the Consumer is obliged to pay, if performance began with their prior explicit consent and after informing them about losing the right of withdrawal and after receiving confirmation from us. Appropriate checkboxes/information are used on the Website before purchase.

Users who are not Consumers – no right of withdrawal applies.

XX. Technical and operational provisions specific to “Damage History”

Nature of the Report: The Report focuses on information on traffic damages and related events (e.g., insurance entries, collisions, total losses, post-accident auctions, towing). The scope may vary depending on Sources, the vehicle's registration/use country, and the time frame of data availability.

Time and completeness: no guarantee of completeness or continuity of entries (e.g., damages not reported/settled outside the system, damages from private policies, damages without compensation payments may not appear in the Sources).

Registration numbers: in some countries, license plates may be transferred assigned to the owner or region; the reported history may pertain to a given identifier at a specific time. We recommend inquiries by VIN for greater certainty.

Interpretation: damage item descriptions can be brief/technical; the Site may present simplified descriptions/classifications based on mapping and algorithms, which does not constitute technical expertise.
